Politika Zaštite Konkurencije Od Pravila Per Se Do Pravila Zasnovanih Na Razumu: Istorijska Putanja I Njene Implikacije (Competition Policy From The Per Se Rules To The Rules Of Reason: Historical Path And Its Implications)

Abstract

Vođenje politike zaštite konkurencije se zasniva na usvojenom kriterijumu za zaštitu konkurencije i pravilima koja se primenjuju kako se bi se proverila saglasnost analiziranih poslovnih praksi upravo sa tim kriterijumom. Glavni akteri, u užem smislu, nacionalnih sistema zaštite konkurencije su stručne i nezavisne komisije, sa primarnim ciljem da provere pomenutu saglasnost sa postavljenim kriterijumom. Nesumnjivo, zaštita blagostanja potrošača se nametnula kao kriterijum za zaštitu konkurencije u vodećim svetskim praksama iz ove oblasti. U ovom radu će biti prikazana istorijska putanja ove politike, od proste primene pravila per se do sofisticirane primene pravila zasnovanih na razumu. Videćemo da je unutar ovog kontinuuma moguće efikasno pozicionirati vođenje ove politike u zavisnosti, pre svega, od raspoloživih resursa komisija, te složenosti i veličine slučaja koji je predmet analize. Istorijska putanja će biti prikazana iz ugla vodeće svetske prakse iz oblasti zaštite konkurencije, sa namerom da se ukaže na ključne implikacije za mlade sisteme za zaštitu konkurencije, u koje se i srpski sistem može uvrstiti.
