El papel de los criptoactivos como moneda de curso legal: el ejemplo de El Salvador

Abstract

El pasado 7 de septiembre de 2021, El Salvador se convertía en la primera jurisdicción en adoptar el bitcoin como moneda de curso legal en su territorio, una iniciativa que ha despertado expectación y escepticismo a partes iguales, y que, potencialmente, abre una puerta para que otros países puedan seguir su ejemplo. La iniciativa se soporta en una ley adoptada por la Asamblea Legislativa y deja los aspectos más funcionales a una serie de normas técnicas elaboradas por el banco central. Para facilitar su despliegue operativo, el Gobierno ha optado por ofrecer una billetera digital y ha puesto, además, en marcha un ambicioso programa educativo para el conjunto de la población. Desde los organismos internacionales se considera que esta propuesta entraña riesgos importantes para la economía en general: podría comprometer tanto el sistema monetario salvadoreño como la integridad de su sector financiero, así como mermar la capacidad recaudatoria del Estado. El escenario final resulta una gran incógnita y dependerá, en gran medida, de la capacidad del país para superar no solo las dificultades evidenciadas en su lanzamiento, sino también otras deficiencias estructurales preexistentes.
