Unele consideraţiuni privind constrângerile Sistemului de la Madrid pentru înregistrarea internaţională a mărcilor

Abstract

De-a lungul anilor a fost abordat frecvent și argumentat subiectul avantajelor Sistemului de la Madrid, comodităţii și atuurilor economice pe care acesta le oferă utilizatorilor. Mai puţină atenţie a fost acordată însă constrângerilor acestui sistem internaţional de înregistrare a mărcilor și prevederilor lui care necesită a fi revizuite pentru adaptarea sistemului la cerinţele utilizatorilor. Aceste aspecte vor fi abordate, într-o manieră constructivă, în prezenta lucrare. În special, în lucrare sunt expuse unele consideraţiuni privind clauza de dependenţă stipulată în art. 6al Protocolului de la Madrid, imposibilitatea introducerii modificărilor în semnul revendicat într-o înregistrare internaţională și limitele impuse de Sistemul de la Madrid în cazul solicitanţilor multipli.
