Corelaţia conceptelor: ordine publică, securitate publică, ordine de drept în contextul încadrării juridice a infracţiunii de huliganism

Abstract

Problema determinării conceptului de ordine publică, în raport cu conceptul de securitate publică și ordine de drept, este de importanţă majoră pentru practica de aplicare a normelor de drept, deoarece anume această categorie se prezintă în calitate de criteriu de sistematizare pentru formarea grupului de infracţiuni din care face parte şi huliganismul. Despre existenţa separată a categoriilor de securitate publică şi ordine publică indică şi formularea titlului Capitolului XIII: „Infracţiuni contra securităţii publice şi a ordinii publice” al Codului penal al Republicii Moldova. În aşa fel, însăşi legiuitorul stabileşte atât autonomia, cât şi coerenţa conceptelor menţionate.
