Distrugerea bunurilor în legislaţia penală a Republicii Moldova şi a României: aspecte de drept comparat

Abstract

Studiul propus se referă la analiza comparativă a cadrului incriminator ce privește infracţiunile de distrugere sau deteriorare a bunurilor prevăzute la art. 197 al Codului penal al Republicii Moldova şi, deopotrivă, a infracţiunilor prevăzute la art.253, art.254 și art.255 ale Codului penal al României, care incriminează faptele prejudiciabile de distrugere, distrugere calificată și, corespunzător, distrugere din culpă. Investigaţia în cauză, ca premisă a perfecţionării cadrului incriminatoriu incident protecţiei relaţiilor sociale patrimoniale, are scopul de a evidenţia elementele constitutive obiective și subiective ale ambelor modele de incriminare, în vederea aprecierii discrepanţelor și similitudinilor caracteristice construcţiei și structurii tehnico-legislative ale ambelor infracţiuni.
