Interferenţa dintre dreptul concurenţei și drepturile de proprietate intelectuală prin prisma dreptului comunitar

Abstract

Interacţiunea dintre drepturile de proprietate intelectuală (DPI) și Legea concurenţei creează, unul dintre cele mai necesare aspecte pentru păstrarea dinamicii concurenţiale pe piaţă. Scopul cercetării prezente este de a analiza aspectele teoretice și practice ale relaţiei dintre protecţia drepturilor intelectuale și protecţia concurenţei în vederea identificării consecinţelor aplicării dreptului concurenţei în situaţii privind drepturile de proprietate intelectuală și viceversa. În vederea realizării scopului stabilit, autorii cercetează câteva speţe care vin să elucideze interferenţa dintre dreptul de proprietate intelectuală și cel al concurenţei. Studiul arată că nu este ușor să obţii întotdeauna un echilibru corect între drepturile de proprietate intelectuală și dreptul concurenţei, iar găsirea echilibrului este pe cât de complexă pe atât de necesară pentru a asigura un mediu concurenţial propice dezvoltării economice.
