Continuities and ruptures in the regulatory framework and public policies for the Argentine metalliferous mining sector (1990-2019)

Abstract

In this article we discuss the continuities and ruptures in public policy for the metal mining sector in Argentina from the 1990s to 2019. Through secondary sources, we explore the transformation of the regulatory framework, the permeability of reforms to the economic context and the emergence of socio-environmental conflicts together with their effects on provincial legislation. We find that the application of exchange and fiscal stability, which the regulatory framework seeks to guarantee, has been interrupted throughout the period analysed. As a result of the socio-environmental conflicts, legislation banning metal mining was enacted, which constitutes the main break with the 1990s. A relevant continuity over the years has been insufficient investment in institutional strengthening.
