Upholding human rights in the fight against terrorism

Abstract

This article is about counterterrorism and terrorism-related human rights concerns. We are living in a globalising world in which people are increasingly faced with the dilemma of fighting against terrorism while protecting human rights. This paper suggests that eradicating terrorism can have a far-reaching effect on the overall respect for human rights. Human rights have to be seen as the basis of counterterrorist legislation and are never to be regarded as a hindrance of the struggle against terrorism. The paper argues that the threat of terrorism requires specific measures, but these provisions neither would violate human rights and fundamental freedoms nor undermine legitimate dissent. In this paper, I shall discuss the counterterrorist measures at international, regional and national levels, and also briefly describe the nexus between terrorism and the protection of human rights.
