Considerations On The Company-Guaranteed Loans

Abstract

The occurrence of one of the greatest financial crisis in the world, first in the United States and then in Europe, and afterwards the analysis of the factors generating it, allowed us to identify, among its triggering factors, the problem of the guarantees accepted by the creditors, as well as the general guaranteeing principles used when guaranteeing contracted loans. In this context, it was proved to be extremely important that the banks identify and require borrowers guarantees to cover the risk of default at maturity of the installments and interests corresponding to the loan, as the guarantees must be considered secondary sources of loan reimbursement, and the quality, the liquidity and the size of the guarantee influence even the loan risk level.
