Własność przemysłowa w sektorze rolno-spożywczym; wybrane zagadnienia prawne

Abstract

The aim of this article is to present selected legal issues connected with industrial property with relation to the agri-food sector, in particular patents, trademark, protected geographical indication, protected designation of origin and others. In the end of this paper, the financial support for developing of industrial property is presented. / Synopsis. W artykule przedstawiono wybrane zagadnienia prawne poświęcone własności przemysłowej, w zakresie istotnym dla sektora rolno-spożywczego. Do szczególnie ważnych instytucji zaliczyć należy patent na wynalazek, prawo z rejestracji wzoru przemysłowego oraz prawo ochronne znaku towarowego. W podsumowaniu stwierdzono, że z jednej strony zauważyć można pozytywny wpływ „good governance”, ujmowanego jako efektywne zarządzanie, na rozwój własności przemysłowej w branży rolno-spożywczej. Chodzi przede wszystkim o podejmowane przez organy administracji działania na rzecz rozpowszechniania wiedzy o własności intelektualnej, w tym szczególne przeznaczanie środków na finansowanie procedury udzielania ochrony oraz szkolenia, publikacje. Z drugiej strony zauważyć można stymulujące oddziaływanie własności przemysłowej na zarządzanie administracją publiczną, tworzenie warunków dla rozwoju gospodarczego oraz demokratyzacji.
