Is the Islamic Mutual (Composed)Insurance a Commercial Insurance? هل التأمين الإسلامي المركب تأمين تعاوني أم تجاري؟

Abstract

To answer the question, the characters and properties of mutual and commercial insurance are surveyed, and compared with Islamic mutual (composed) insurance model. The finding is that, the Islamic insurance model as practiced is a commercial insurance; its business is to exchange the risk for a premium, the difference between them is artificial to fulfil the Islamic restrictions on insurance activity. The research also find that risk is higher in Islamic model since the insured will bear the risk of the investment of the premiums and insufficient to pay the loss. للإجابة على التساؤل، تم استعراض خصائص ومواصفات كلا من التأمين التعاوني والتجاري، ثم بيان حقيقة التأمين التعاوني الإسلامي (المركب) الذي تمارسه شركات التأمين الإسلامية، وقد وجد أن شركات التأمين الإسلامية في حقيقتها هي شركات تأمين تجارية يتم فيها نقل الخطر بعوض، والفرق بينهما فروق شكلية وليست حقيقية، اضطرت الشركات إليها لتحقق شكليا الشروط الشرعية لممارسة التأمين، كما وجد أن الغرر فيها أكبر من شركات التأمين التجارية، إذ يتحمل المستأمن فيها مخاطر الاستثمار باعتباره رب المال، كما يتحمل مخاطر عدم كفاية الأقساط للتعويضات، بينما تتحمل ذلك الشركة في حالة التأمين التجاري.
