Abstract

-- ما قاله الدكتور الفنجري في كتابه (ص 122) في الحاشية. ويبدو أنه لا يفرق بين القرض والدين (الناشئ عن بيع). والحقيقة أن فقهاءنا يقولون بأن للزمن حصة من الثمن. وواضح أن عبارة "الثمن" هنا تعني أن الأمر يتعلق بالبيع لا بالقرض. ولهذا يجوز عند جمهور الفقهاء زيادة ثمن البيع لقاء التأجيل، والحطيطة منه لقاء التعجيل. لكن لو استحق الثمن وكان المدين معسرًا لأصبح الدين كالقرض، لا تجوز فيهما أية زيادة وقد فصلنا ذلك في غير هذا الموضع. ومن هذا يتبين أن قول د. الفنجري بأن الشريعة الإسلامية لا تقيم للتأجيل ثمنًا، قول غير صحيح، وهو نفسه لا يمنع زيادة الثمن لمجرد التأجيل، بدليل ما قاله في (ص 125) وحاشيتها حول "البيع المؤجل بثمنٍ أعلى" و "البيع بالتقسيط".
