Abstract

-- إن أحد جوانب أهمية عقد السمسرة في نظرية الاقتصاد الإسلامي، هو أنه يمثل أسلوبًا خاصًا في تعويض العمل بوصفه عنصرًا إنتاجيًا. 1- فالأصل شرعًا فيمن يعمل لغيره بعوض أن يكون ذلك بعقد إجارة يحدد فيه مقدار الأجر ومقدار العمل. وتحديد مقدار العمل يكون بأحد أسلوبين مقبولين شرعًا: بالوصف الواضح، كخياطة ثوب معين، أو بالزمن الني يضع فيه العامل نفسه تحت تصرف صاحب العمل، كمن يتعاقد لقاء أجر محدد على طباعة ما يكلفه به صاحب العمل خلال يوم معين. ويعتبر عدم تحديد الأجر أو مقدار العمل جهالة مفسدة للعقد. وهذا الأسلوب من تعويض العمل بوصفه عنصرًا إنتاجيًا، لا يتحمل فيه العامل أية مخاطرة خلال العقد.
