Особенности Злоупотреблений Законодательной Власти

Abstract

В статье выделены и проанализированы основные аспекты идеи приоритета законодательной ветви государственной власти над иными ее институтами. Злоупотребления в современной российской законотворческой (правотворческой) политике осуществляются на федеральном и региональном уровнях, они обусловлены переходной правовой системой, нарушением баланса правовых стимулов и ограничений функционирования субъектов законотворческой деятельности. Выявлены типичные и социально опасные (легальные и нелегальные) злоупотребления в сфере постсоветской правотворческой политики. В статье обосновывается целесообразность проведения комплексной экспертизы законопроектов, включающей финансово-экономическую, антикоррупционную, экологическую и социальную составляющие.
