El Proceso de Adjudicación de Obras Públicas y la Normativa Europea: Una Aproximación desde la Teoría de Subastas

Abstract

La importancia de las obras públicas como promotoras de la actividad económica y del desarrollo social, se ha puesto de manifiesto en numerosos estudios. Especialmente en el apartado dirigido a infraestructuras de comunicación, principalmente carreteras y autopistas. Este trabajo comienza con una breve revisión de los distintos tipos de subastas, y la legislación europea sobre este tema, a continuación plantea el encuentro de los agentes que intervienen en la adjudicación de dichas construcciones, es decir Administración Pública y empresas constructoras. Para cada subasta se parte de distintas hipótesis, que llevan a soluciones diferentes. Se comprueba, sin embargo, que los resultados pueden llegar a ser relativamente cercanos a los competitivos, siempre que la Administración Pública, único comprador, haga que las licitaciones se lleven a cabo bajo unas condiciones propicias para acercarse a dichos resultados competitivos.
