Abstract

Наука торгового права зародилась в России в самом начале XIX в. в процессе разработки проекта Торгового уложения и изначально включала в состав научные концепции торгового (коммерческого) судоустройства и судопроизводства. Задолго до судебной реформы в рамках торгового процессуального права в «Учреждении коммерческих судов и Уставе их судопроизводства» были выработаны и реализованы принципы буржуазного судоустройства и судопроизводства по торговым делам. Соответственно, судебная реформа 1864 г. не могла внести ничего нового в организацию коммерческих судов и их судопроизводство.
