Investigación: Anatocismo: Un vocablo poco feliz para incorporarlo en nuestro nuevo código civil y comercial

Abstract

El proyecto de unificación de los códigos civil y comercial abre una instancia muy interesante para el debate de diferentes temas. En particular, en este trabajo se aborda el tratamiento legislativo que se ha propuesto para las obligaciones de dar sumas de dinero, incluyendo sus intereses y cálculo. Se pretende clarificar desde un enfoque matemático las distintas formas de cálculo de los intereses y la posibilidad de su capitalización, que la doctrina y jurisprudencia define como anatocismo, destacando como inapropiada su aparición en el texto de ley propuesto.
