Unzulässige Einschränkung der Rechte kritischer Mitglieder einer Kreditgenossenschaft

Abstract

Some cooperative banks try to force members who criticise their business policy or planned mergers outside the cooperative by terminating the business relationship with them and their affiliated companies and/or persons close to them. Attempts are also made to make contact and communication between critical members of the cooperative and other members impossible or at least difficult by withholding the lists of members and representatives. Are the statutory rights of the affected members of the cooperative thereby restricted in an inadmissible manner, and are cooperatives acting in this way violating their duty of loyalty to each member?
