Abstract
Die vergangenen zehn Jahre haben die Defizite der europäischen Asylpolitikoffengelegt. Uneinheitliche Umsetzungen der gesetzlichen Regelungen und die ungleiche Belastung der EU-Länder haben in Anbetracht andauernd hoher Asylantragszahlen zu einer Überlastung des europäischen Asylsystems und zu großem Unmut in den Mitgliedstaaten geführt, so dass eine Reform der gemeinsamen europäischen Asylpolitik unumgänglich wurde. Die Reform führt mit dem Asylgrenzverfahren ein beschleunigtes Verfahren ein, das eine schnellere Abschiebung von Personen mit schlechten Bleibeperspektiven ermöglicht. Zwar obliegt die Prüfung der Asylanträge weiterhin dem EU-Ersteinreiseland, es sollen allerdings 30 000 Geflüchtete jährlich auf die Mitgliedstaaten verteilt werden. Im Falle stark steigender Antragszahlen tritt eine neu eingeführte Krisenverordnung in Kraft, die Eilverfahren für Registrierung und Abschiebung vorsieht. Ein Hauptproblem der hohen Asylantragszahlen wurde mit der Reform allerdings nicht adressiert: Es fehlen legale Einreisewege in die EU für Menschen, deren Fluchtgründe nicht Krieg und Verfolgung sind, sondern wirtschaftliche Ursachen haben.
