La solución de controversias en los acuerdos regionales de América Latina con países desarrollados

Abstract

El mecanismo de solución de controversias es uno de los elementos centrales de todo acuerdo comercial en tanto se constituye en el medio para garantizar el cumplimiento de los compromisos adquiridos. Si bien los distintos mecanismos existentes tienen elementos en común, lo cierto es que también presentan características propias las que, a su vez, inciden en su funcionamiento. El objetivo de este trabajo es analizar comparativamente el sistema de solución de controversias de la Organización Mundial de Comercio y los mecanismos de solución de controversias incluidos en los acuerdos negociados por Estados Unidos, la Unión Europea y Japón con países de América Latina y el Caribe, a efectos de identificar los objetivos, elementos e incentivos de cada sistema, evaluar su eficacia y extraer lecciones de política relevantes para los países de la región.
