Estudio sobre la propiedad intelectual en el sector farmacéutico colombiano

Abstract

Este estudio tiene un doble propósito. Por una parte, busca establecer el impacto que ha tenido el régimen de protección de propiedad intelectual (en adelante, régimen de protección) que aplica al sector farmacéutico en Colombia sobre el costo y el acceso a los medicamentos, a la luz de los datos disponibles. Por otra, busca entregar elementos para evaluar a futuro el impacto qué podrían tener modificaciones a ese régimen de protección. La aproximación metodológica es de carácter empírico. La mayor parte del trabajo que se presenta es descriptiva y tiene el propósito de contribuir a dimensionar adecuadamente el mercado de farmacéuticos en Colombia desde ángulos diversos. Adicionalmente, se presenta un ejercicio estadístico que arroja luz acerca del proceso de formación de precios en el mercado farmacéutico. No se presentan simulaciones del desempeno futuro del mercado, pero sí se revisan los elementos que serán claves para el mismo. El foco de atención es la salud de los colombianos. Este estudio no considera el impacto que el régimen de protección pueda haber tenido, tenga o pueda llegar a tener, sobre la industria farmacéutica en el mercado nacional.
