Aspecte privind delimitarea infracțiunii de fals în acte publice de cea de fals al probelor

Abstract

Activitatea profesională de încadrare corectă și eficientă a dispozițiilor normelor juridice din Partea Specială a Codului penal, în coraport cu fapta antisocială săvârșită în realitatea obiectivă, presupune cunoașterea ireproșabilă și fără defect a acestor prevederi legislative. Falsificarea probelor și falsul în acte publice, la prima vedere, par a fi două norme penale cu esența structurii juridice asemănătoare, însă, în procesul de realizare a unor studii aprofundate la acest segment de cercetare, s-a obținut un rezultat cu totul diferențiat. Astfel, în vederea excluderii calificării eronate a faptelor antisociale dislocate la art.310 și art.332 din Codul penal, autorul a realizat prezentul studiu teoretic și cazuistic privind delimitarea infracțiunii falsificarea probelor de falsul în acte publice.
