Alternative de protecție a drepturilor de proprietate industrială a IMM-urilor împotriva concurenței neloiale

Abstract

Sectorul IMM reprezintă, probabil, cea mai vulnerabilă categorie de subiecți și, corespunzător, cea mai supusă riscului de afectare a intereselor sale prin intermediul încălcării drepturilor de proprietate intelectuală deținute (în particular, drepturile de proprietate industrială). Legislația aferentă protecției drepturilor de proprietate industrială este construită în mod simetric, fiecare dintre actele normative care reglementea-ză regimul juridic al obiectelor respective fiind de-terminat de existența normelor juridice formulate similar (conform aceluiași model). Astfel, actele normative în cauză reglementează condițiile de protecție a obiectelor de proprietate industrială, precum și aspectele procedurale relevante (subiecți care dețin drepturi de sesizare, autorități competente etc.). Prin urmare, mecanismul protecției obiectelor de proprietate industrială prin prisma normelor legale specificate nu prezintă complexitate semnificativă. În plan contrar, protecția obiectelor de proprietate industrială și a drepturilor aferente împotriva concurenței neloiale impune întrunirea unor condiții suplimentare de ordin material și procedural în sensul apărării drepturilor în cauză. În contextul dat, prin intermediul prezentei comunicări au fost elucidate aspecte specifice procedurii de apărare a drepturilor de proprietate industrială împotriva unor eventuale acțiuni de concurență neloială
