Analiza juridico-penală a infracţiunii de încălcare a dreptului de autor și a drepturilor conexe

Abstract

Drepturile de autor reprezintă expresia juridică a legăturii existente între operă și creatorul ei. Astfel, apărarea drepturilor de proprietate intelectuală devine treptat un domeniu prioritar pentru Republica Moldova. Acest fenomen este condiţionat de tendinţa ţării noastre de a se integra în Comunitatea Europeană. Ţinând cont de faptul că pentru ţara noastră instituţia dreptului de autor și a drepturilor conexe este relativ nouă, un element de o importanţă majoră în procesul de dezvoltare și îmbunătăţire a sistemului naţional de proprietate intelectuală îl constituie armonizarea legislaţiei Republicii Moldova cu standardele stabilite de către Uniunea Europeană. Obiectivul primordial înaintat în cadrul acestui articol îl constituie prezentarea sumară a elementelor și semnelor componente ale infracţiunii de încălcare a drepturilor de autor și a drepturilor conexe prin prisma sediului normativ incriminator stipulat la art.1851 C.Penal al Republicii Moldova.
