Consideraţii generale privind justiţia, statul de drept şi puterea judecătorească

Abstract

Justiţia a fost percerută mereu ca o funcţie fundamentală a statului, motiv pentru care administrarea ei reprezintă unul dintre scopurile majore ale statului de drept. Fără justiţie nu poate exista o veritabilă şi eficientă democraţie. Anume justiţia este cea care veghează la apărarea valorilor sociale recunoscute într-o societate democratică, la promovarea şi apărarea drepturilor fundamentale ale omului. Justiţia este, prin urmare, unul dintre elementele esenţiale ale statului de drept şi ale consolidării lui.
