Mecanismos de Justicia Penal Internacional Ad-Hoc - La realidad y la posibilidad de un idealismo pragmático

El trabajo que se encuentra a continuación, no es más que una pieza introductoria al tópico de los mecanismos de justicia penal internacional. Una temática que comenzó a adquirir relevancia a los efectos del estudio de sociedades en transición, sobre todo aquellas que han atravesado graves crisis humanitarias. Lo que intentamos resolver a lo largo del trabajo de investigación es el interrogante de cuáles son las causas por las que los mecanismos de justicia ad hoc no logran su objetivo de disuasión, de poner fin a las violaciones al derecho internacional humanitario, por lo menos, en los territorios que entran bajo su jurisdicción. Para ello, se analizan cuatro casos de respuestas institucionalizadas a las pasadas violaciones del derecho internacional humanitario: el Tribunal Penal para la Ex Yugoslavia, el Tribunal Penal Internacional para Ruanda, los Paneles Especiales del distrito de Dili en Timor Oriental y la Corte Especial para Sierra Leona; y se busca definir cuáles son las ventajas y desventajas de las diferentes características de los mismos para la consecución de su razón de ser, es decir, el logro de poner fin a la impunidad y contribuir al restablecimiento de la paz. Desde una mirada "idealista pragmática", el trabajo concluye que si bien los mecanismos no están capacitados per se para cumplir con la magnitud de sus objetivos, sí constituyen un avance en lo que respecta al aprendizaje sobre métodos más efectivos para enfrentar a situaciones pos crisis.
