Die soziale Sicherung von selbstständig Erwerbstätigen in Deutschland

Abstract

Erläutert werden Art und Umfang der Einbeziehung der Selbstständigen in die einzelnen Sozialversicherungszweige, Sonderregelungen für bestimmte Gruppen von Selbstständigen, die gesetzlichen Regelungen zur Scheinselbstständigkeit und besondere sozialrechtliche Bedingungen bei arbeitsmarktpolitisch geförderter Selbstständigkeit (Ich-AG und Überbrückungsgeld). Es wird argumentiert, dass die Gesetzgebung zur sozialen Sicherung Selbstständiger widersprüchlich und unvollständig bleibt. Überfällig ist die Anerkennung des generellen sozialen Schutzbedarfs der Selbstständigen und die Ausweitung der Sozialversicherungspflicht auf alle Selbstständigen. Abschließend werden aktuelle Bestrebungen zur Reform der Sozialversicherungsregelungen für Selbstständige erörtert und bewertet.
