Umsetzung des Fiskalpakts im Euro-Raum: Expertise im Auftrag des Sachverständigenrates zur Begutachtung der gesamtwirtschaftlichen Entwicklung

Abstract

[Schlussfolgerungen] Das Gesamtbild der Umsetzung des Fiskalpaktes in nationales Recht ist zu diesem Zeitpunkt durchwachsen. Einerseits ist es erfreulich, dass gerade von der Krise stark betroffene Länder wie Spanien und Portugal sehr ernsthafte und vielversprechende Regelungen verabschiedet haben. Auf der anderen Seite ist es kein gutes Zeichen, dass ausgerechnet Griechenland erneut in Gefahr ist, Fristen zu versäumen und wichtige Gesetzgebungsverfahren zu verschleppen. Auch die Tatsache, dass einige Länder sich auf einfachgesetzliche Regelungen verlassen und keine Restriktionen von Verfassungsrang einführen, trübt den Gesamteindruck. Die deutliche Mehrheit der Länder verfügt auch bereits über gesetzliche Grundlagen für unabhängige Fiskalräte, in einigen Ländern sind die Räte auch bereits ernannt. Hier zeigt sich eine erfreuliche Tendenz zur Ernennung relativ politikferner Mitglieder, etwa aus der Wissenschaft und in Einzelfällen auch aus dem Ausland. Hier kann also zunächst eine relativ hohe faktische Unabhängigkeit in der Arbeit der Fiskalräte erwartet werden. Allerdings ist das Ernennungsverfahren selbst weiterhin in der Regel ein politisches Verfahren, in dem Parlament und Regierung eine zentrale Rolle spielen. Ob die Unabhängigkeit der Fiskalräte durch Politikferne ihrer Mitglieder also auch dauerhaft gewährleistet werden kann, bleibt offen und wird sich erst langfristig zeigen. Nicht in allen Ländern ist dies tatsächlich institutionell abgesichert, etwa durch ein explizites Verbot, aktive (oder noch kürzlich aktive) Politiker in die Fiskalräte zu wählen.
