Familienbesteuerung und Splitting: Änderungsvorschläge auf dem Prüfstand

Abstract

Die aktuelle Diskussion in der Familienbesteuerung ist durch die Steuertechnik des Splittings geprägt, wobei zwei gegensätzliche Reformvorschläge dominieren: Die Abschaffung des Ehegattensplittings auf der einen und die Ausweitung des Ehegatten- auf ein Familiensplitting auf der anderen Seite. Das Institut greift in seiner Schrift diese beiden Ansätze auf und diskutiert sie vor dem Hintergrund ihrer steuersystematischen und verfassungsrechtlichen Implikationen. Dabei werden ausgehend vom bestehenden Recht zuerst die Argumente für und wider das Ehegattensplitting abgewogen. Die Studie kommt zu dem eindeutigen Ergebnis, dass weder eine Abschaffung noch eine Einschränkung des Ehegattensplittings zulässig ist. Es folgt eine Analyse der Idee, das Splittingverfahren durch Einbezug von Kindern zu erweitern. Ein solches Familiensplitting ist grundsätzlich mit dem verfassungsrechtlichen Gebot der Verschonung kindesbedingter Ausgaben vereinbar. Aus steuersystematischer Sicht wäre dieses jedoch gegenüber einem kindesbedingten Freibetrag nur eine zweitbeste Lösung. Insgesamt enthält die Studie ein Plädoyer für die Beibehaltung der aktuellen Regelungen der Familienbesteuerung. Ein kindesbezogener Freibetrag stellt nach wie vor die beste und sachgerechte Berücksichtigung von Kindern in der Einkommensteuer dar. Ebenso ist das Ehegattensplitting solange notwendig, wie ein direkt progressiver Einkommensteuertarif zur Anwendung kommt.
