Abstract

[Schlussfolgerungen] Vor dem Hintergrund der rechtlichen, rechtspolitischen und ökonomischen Bedenken ist es skeptisch zu bewerten, dass ein substanzieller Ausbau des Herkunftslandprinzips insoweit realisierbar ist, dass Unternehmen die nationale Rechtsordnung ihres Herkunftslands bei Investitionen oder Niederlassungen in Krisenländern mitnehmen und so über einen Wettbewerb der Rechtssysteme einen Anpassungsdruck in den Krisenländern auslösen. Dieser auf den ersten Blick interessante und wirkungsvolle Ansatz zeigt sich bei näherer Betrachtung als nicht realisierbar. Für die weitere Forschung wäre es jedoch interessant zu untersuchen, wie durch Modelle der partiellen Privatisierung von staatlichen Kontrollaufgaben und die Übertragung gegebenenfalls auch an die Europäische Kommission oder an ausländische öffentliche Entitäten im Wege der Organleihe ein Anpassungsdruck auf nationale Instanzen ausgeübt werden kann.
