Abstract

El presente trabajo reseña la Concesión de Aguas Provinciales de Santa Fe (Ex-DIPOS), centrándose en el análisis de la privatización y regulación económica del servicio público. Para ello se analiza el proceso desde el momento de la Concesión del servicio a Aguas Provinciales de Santa Fe S.A., el Contrato de Concesión y la Ley Provincial Nº11220 que tienen incidencia en materia de regulación económica. También se presenta información sobre los problemas de diseño tarifario e inversiones (expansión del servicio) y de la renegociación que comenzó en abril de 1999, la cual no se ha cerrado hasta el día de hoy (febrero 2002), profundizándose las diferencias entre las partes debido a los cambios en el contexto macroeconómico que sufrió la República Argentina a partir de diciembre de 2000. Con respecto a este punto se señalan los procedimientos establecidos en el proceso de la privatización para enfrentar esta eventualidad contractual.
