Abstract

Le présent document est une synthèse des questions relatives à la transparence des procédures de règlement des différends entre investisseurs et États et à la participation de tierces parties à ces procédures. La Section I examine comment les règles en vigueur s’appliquent à ces questions. La Section II décrit les mesures adoptées par les tribunaux arbitraux et le Centre international pour le règlement des différends relatifs aux investissements (CIRDI) pour améliorer la transparence du système au niveau gouvernemental. La Section III examine les avantages perçus d’une plus grande transparence et les difficultés qu’elle pose. La dernière section fournit un résumé du document.
