Respeito às Normas e Crescimento Econômico: Como Promotores Públicos Garantem o Cumprimento das Leis e Promovem o Crescimento Econômico no Brasil

Abstract

Esta pesquisa examina como os membros do Ministério Público (MP) brasileiro conseguem que empresas instaladas em território nacional cumpram com a legislação trabalhista e ambiental sem perder a competitividade. Nos casos analisados, promotores e procuradores percebem que os gargalos que dificultam o cumprimento da lei estão freqüentemente fora das empresas infratoras e de suas respectivas cadeias de valor, e que, portanto, abordagens baseadas em punição, persuasão ou educação – todas centradas na empresa – não são suficientes. Para promover o cumprimento das leis esses agentes públicos localizam e dimensionam os gargalos mais importantes e montam um time composto por instituições públicas, privadas e não-governamentais dispostas a compartilhar os riscos e benefícios associados com a remoção desses gargalos e a mudança na estrutura produtiva das empresas em questão. Na prática, esse processo, que os promotores e procuradores chamam de “costura”, modifica o ambiente onde as empresas operam de forma a tornar o cumprimento da lei a alternativa mais simples e óbvia para todos os envolvidos. This paper examines how Brazilian prosecutors promote compliance with labor and environmental laws while preserving or even enhancing the competitiveness of local firms. In the cases analyzed, prosecutors realize that the bottlenecks that prevent compliance are often located outside the firm and its immediate value chain, so punishment or pedagogy, when used in isolation, are not likely yield meaningful results. Instead, they locate key bottlenecks, assess them, and then, depending on the task ahead, bring together a series of public, private, and non-profit institutions willing to share, according to their respective tolerance and ambition, the risks and benefits associated with the necessary change. This process, which prosecutors themselves call “to stitch it together”, effectively modifies the environment in which firms operate so as to make compliance the easy and obvious choice for all involved.
