Abstract

El Tratado de Libre Comercio de América del Norte (TLCAN) incluyó, por primera ocasión en un tratado de libre comercio (TLC), disciplinas de amplio alcance en materia de inversión, además de un mecanismo a través del cual un inversionista puede demandar a un Estado por violación del nivel de protección previsto en el acuerdo. El tema es una alta prioridad en la agenda estadounidense de negociaciones comerciales internacionales y ha sido incorporado en los tratados de libre comercio que este país ha negociado en el hemisferio después del TLCAN, Chile (TLC Chile) y Centroamérica (TLCCA). Además, seguramente formará parte de los acuerdos entre Estados Unidos (EE.UU.) y los países andinos, ya que constituye uno de los grandes intereses ofensivos estadounidenses. En este mismo contexto, en caso de que el ALCA prospere, muy probablemente incluirá un mecanismo de solución de controversias inversionista-Estado. Una vez dicho esto, el capítulo de inversión del TCLAN ha sido objeto de enorme controversia debido al potencial alcance de las decisiones emitidas por los paneles constituidos en virtud del denominado mecanismo inversionista-Estado
