知的財産権に関する行政裁判の実証分析－勝訴確率と代理人の数, 審査期間の間の因果関係について－

Abstract

本稿では,知的財産権に関する行政裁判のデータを用いて,訴訟における勝訴確率,審査期間,原告側の代理人の数の間の因果関係を実証的に明らかにする。本稿におけるデータセットでは原告が被告に対してどんな申立てをしているのかを識別できるので,それを操作変数に用いて,勝訴確率,審査期間,代理人の数の間の内生性に対処することができた。その結果,代理人の数が多くなると審査期間は短くなるが勝訴確率が低下し,審査期間が長引くと敗訴する確率が高くなることがわかった。また,審査期間が長くなりそうなケースには比較的少数の代理人が配分される傾向にあることがわかった。
