La défiscalisation des heures supplémentaires : les enseignements de l’expérience française

Abstract

La loi TEPA du 1er octobre 2007 a considérablement allégé la fiscalité sur les heures supplémentaires. Son objectif était de diminuer le coût du travail afin d'augmenter les heures travaillées et le revenu des salariés. Cette étude évalue son impact, en comparant l'évolution, avant et après la réforme, du nombre d'heures travaillées par les salariés transfrontaliers avec celles des salariés résidant près de la frontière tout en travaillant en France. Les premiers n'ont pas été affectés par la réforme alors que les seconds l'ont été. Les résultats indiquent que la défiscalisation des heures supplémentaires n'a pas pleinement atteint son objectif : si les salariés concernés ont bien bénéficié d'un surcroît de rémunération, ce n'est pas en moyenne en travaillant plus. La réforme n'a eu aucun impact significatif sur le nombre d'heures travaillées. Elle a en revanche suscité une optimisation fiscale des salariés qualifiés qui ont déclaré plus d'heures supplémentaires – afin de bénéficier de la défiscalisation – mais qui n'ont pas travaillé plus.
