Cette communication porte sur la possibilité d'un système généralisé et renforcé de droits de propriété (privés) sur la connaissance technique. Les évolutions contemporaines poussent dans cette direction. Il s'agit cependant d'une sorte d'utopie propriétaire non viable et contre-productive, qui rentre fréquemment en contradiction avec la logique propre du changement technique, conduisant à des situations de blocage en matière d'activité inventive et de R&D. Le maintien du domaine public s'impose alors; et, quand celui-ci a disparu, la remise sur pied de formes de propriété collective (communaux ou commons) donne naissance à de nombreux arrangements et bricolages institutionnels portant sur les droits d'accès et d'usage à la connaissance technique.
