L'efficacite du droit spontane: une evaluation microeconomique

Abstract

L'un des arguments presentes en faveur du droit spontane est sa capacite a promouvoir l'efficacite. S'appuyant sur l'analyse economique, l'article se propose de revenir sur cette propriete en interpretant le droit comme une connaissance commune. Nous montrons que des regles emergentes peuvent etre confirmees par n'importe quel type de comportement, ce qui rend une norme superieure, contractuelle, indispensable.
