Abstract

El desarrollo de la infraestructura económica y de servicios públicos en Colombia en las últimas tres décadas ha pasado por dos fases distintas, separadas entre si por la aprobación de una nueva Constitución Política en 1991, evento que significó un cambio radical en las reglas de juego y en los patrones de inversión en estas actividades. En la primera etapa, prácticamente la totalidad de la inversión en infraestructura (salvo en los sectores de minería, petróleo y gas) fue desarrollada por el sector público. En la segunda etapa, el sector privado gana sistemáticamente participación en la inversión prácticamente en todas las áreas de infraestructura. La Constitución de 1991 permitió la competencia y la participación privada en los distintos sectores de infraestructura. Otras normas posteriores de carácter sectorial, como la Ley de Transporte (ley 105 de 1993), las Ley Eléctrica (Ley 143 de 1994) y la Ley de Servicios Públicos Domiciliarios (Ley 142 de 1994), definieron las reglas para la participación privada en cada uno de estos sectores y crearon las instituciones de regulación y control requeridas para estas nuevas condiciones.
