    Abstract

    Las presentes reflexiones surgen de la convergencia de tres circunstancias: a) la obligación de los Estados de proteger y preservar el medio marino establecida en la Parte XII de la Convención de Naciones Unidas sobre el Derecho del Mar (CNUDM); b) la facultad de los órganos jurisdiccionales para decretar, modificar o revocar medidas provisionales bajo ciertas condiciones establecida en la Parte XV de la misma Convención; c) la naturaleza jurídica y alcance del principio de precaución. La confluencia de este triple enfoque es observable en varios casos jurisprudenciales, particularmente, en el de la MOX5 Plant de Sellafield, caso que tuvo varias etapas jurisdiccionales, en distintos ámbitos y por diferentes fundamentos jurídicos, si bien todos encadenados.
