Abstract

Para explicar la singularidad del modelo de policía mexicana y sus nebulosidades jurídicas y su ineficacia institucional, se ensaya aquí la hipótesis que señala la presencia del modelo de seguridad interior previsto en la Constitución de Cádiz (1812) como paradigma constitucional de la actual confusión conceptual de la función policial tanto en la Constitución federal mexicana como en las Constituciones de seis entidades de la región central de México. Sin tener una potestad específica como fuerza pública, ni como policía investigadora, la policía preventiva mexicana obedece más al tipo de policía administrativa pero sin las funciones de tal ni las de una institución a cargo de la seguridad interior. Estos componentes explican los incumplimientos de expectativas ciudadanas que la señalan como policía anticriminal o como una fuerza pública, así como el saldo negativo en un comparativo con cualquier policía del mundo.
