Insolvencia transfronteriza: evolución y estado de la materia

Abstract

En un mundo globalizado los ciclos económicos adquieren gran relevancia para el ordenamiento jurídico, por ser necesaria la regulación de los efectos producidos por la crisis patrimonial de un agente del mercado, para así evitar que los devastadores efectos negativos de la concatenación de patrimonios se extiendan. En un momento que la crisis económica mundial es generalizada e innegable, el autor nos aproxima a la insolvencia transfronteriza, su concepto, principios y desarrollo a partir de la segunda mitad del siglo XIX, en América y Europa, culminando con el análisis de los documentos que en la actualidad resultan relevantes en la materia, el Reglamento Europeo 1346/2000 y la Ley Modelo de la CNUDMI (incorporada a la legislación colombiana mediante la Ley 1116 de 2006), normas que pretenden dar una solución a los eventos en que la crisis patrimonial involucra asuntos de más de una jurisdicción.
