Rawls o Habermas. Un debate de filosofía del derecho

Abstract

John Rawls y Jürgen Habermas representan las dos corrientes filosóficas que mayor influencia han tenido en el derecho en las últimas décadas. A ellos les cabe el mérito de haber interesado de nuevo a la filosofía general en la iusfilosofía, que fue dejada exclusivamente al cuidado de juristas, a más tardar desde Hegel, como lo reconoce autocríticamente Habermas en Facticidad y Validéz, su monumental obra de filosofía jurídica. Allí mismo agrega que los hombres de leyes no fueron en manera alguna inferiores a ese encargo, como lo demuestran las formidables construcciones de Savigny, Feuerbach, Ihering, Duguit, Radbruch, Austin, Kelsen, Hart o Kaufmann, para mencionar a los más salientes.
