La filosofía del derecho contemporánea. Los temas y los desafíos

Abstract

El adjetivo “contemporáneo” genera usualmente incertidumbre: cuando en el lenguaje común hablamos de edad contemporánea nos referimos a la época en que vivimos, asumiendo de esta manera una frontera no definitiva, sino desplazable; en la historia, el inicio de la edad contemporánea se encuentra fijado mediante fechas generalmente precisas, pero que varían en los diferentes países y en las diversas culturas. De aquí la necesidad de indicar el momento del comienzo de la filosofía del derecho contemporánea. Adoptaremos como término a quo el final de los años sesenta del siglo xx, es decir la crisis del modelo iuspositivista en su versión hartiana, o, en otras palabras, el “después de Hart”.
