El principio de proporcionalidad en el Derecho administrativo. Un análisis jurídico desde el Derecho español

Abstract

En los últimos años, ha sido relativamente frecuente encontrar pronunciamientos de la Sala Tercera del Tribunal Supremo español en los que el principio de proporcionalidad ha adquirido un papel destacado. Sin embargo, el contenido estricto del control ofrecido por este principio ha quedado algo desvirtuado a causa de la confusión que el Tribunal Supremo ha aportado en la aplicación del mismo. Así, no es raro que el alto intérprete afirme que “ha de estimarse como objetivamente razonable y proporcionado al fin perseguido, de suerte que [el acto impugnado] no es susceptible de ser calificado de arbitrario o desprovisto de intrínseca racionalidad, es decir, de discriminatorio en el sentido del artículo 14 de la Norma suprema.
