Concepto social de acción e imputación objetiva

Abstract

Está fuera de discusión que el derecho penal debe garantizar una convivencia ordenada de las personas en sociedad y que el Estado tiene encomendada esta tarea de crear y mantener la condiciones vitales mínimas de las personas que conviven en su seno1. Ahora bien, una existencia racional en sociedad implica que la persona no puede vivir sólo para sí misma, pues no sería realista imaginar una vida a lo Robinson Crusoe. Esto significa que la conducta de una persona afecta per se a otros seres humanos, en la medida en que sus respectivos ámbitos de responsabilidad entran en contacto.
