Abstract

En “La investigación encubierta con fines judiciales como técnica especial de investigación” se estudia la legislación vigente para fijar el alcance de los nuevos sistemas de inteligencia e investigación, que buscan derrotar las diferentes formas de organización de la delincuencia. Es importante en la obra tener en cuenta el estudio de instituciones que integran la nueva concepción del derecho fundamental al debido proceso, reflejo del nuevo concepto de Estado social de derecho y los cambios que introdujeron el sistema acusatorio. Respecto del debido proceso, el tratadista expone la necesidad de buscar la verdad como reconstrucción de los hechos que admiten reproche penal, mediante métodos de investigación que pueden afectar derechos fundamentales, y su pertinencia.
