Abstract

El viraje histórico que produjeron los ataques terroristas perpetrados el 11 de septiembre de 2001 condujo a una nueva relación de fuerzas no solo en el plano político internacional, sino también en torno a las normas internacionales vigentes. El presente trabajo de investigación profundiza algunas cuestiones legales que plantea la lucha contra el terrorismo en el actual escenario internacional, tomando como eje central el debate doctrinario en torno a la necesidad de actualizar o no el corpus iuris del derecho de la guerra, especialmente tras los atentados del 11-S. Pretendiendo dar respuesta a numerosos interrogantes de cara a la actualidad del debate, el caso de estudio del presente trabajo detalla la situación jurídica de los prisioneros en la base norteamericana de Guantánamo, así como las repercusiones que ha tenido el caso en la comunidad internacional.
