Steuerausfälle im Bereich der Mehrwertsteuer : Gründe, Ausmaß und Abhilfemöglichkeiten

Abstract

Die vorliegende Arbeit wurde von Andrea Gebauer in weiten Teilen während ihrer Tätigkeit als Wissenschaftliche Mitarbeiterin am ifo Institut erstellt und im September 2007 abgeschlossen. Gegenstand der Arbeit ist die seit 2001 festzustellende schwache Entwicklung der deutschen Mehrwertsteuereinnahmen. Untersucht wird dabei, wodurch diese bedingt ist und durch welche steuerpolitischen Maßnahmen die Mehrwertsteuereinnahmen stabilisiert werden können. Im Rahmen der Analyse möglicher Erklärungsansätze erfolgt erstmals eine grundsätzliche Untersuchung der Relevanz insolvenzbedingter Mehrwertsteuerausfälle (im Zeitverlauf). Darüber hinaus werden der Einfluss einzelner Mehrwertsteuerbetrugsgestaltungen und die grundsätzlichen fiskalischen Unterschiede von Vor- und Mehrwertsteuerbetrug kritisch hinterfragt. Zusätzlich wird anhand der sog. Mehrwertsteuerumgehungsquote eine grundlegend modifizierte makroökonomisch basierte Abschätzung des in Deutschland zu verzeichnenden Mehrwertsteuerbetrugsvolumens vorgenommen. Im Anschluss werden die vom deutschen Gesetzgeber in den letzten Jahren ergriffenen Maßnahmen zur Stabilisierung der Mehrwertsteuereinnahmen analysiert und die bestehenden Handlungsoptionen erörtert. Dabei liegt der Untersuchungsfokus auf den ökonomischen Auswirkungen der in der allgemeinen Diskussion befindlichen umfassenden Reformansätze (v.a. Reverse-Charge- Verfahren und Generelle Ist-Versteuerung, aber auch Ist-Versteuerung mit Quellensteuererhebung) und der Frage, inwieweit diese ihren Zielen (insb. Betrugsbekämpfung und nachhaltige Stabilisierung der Mehrwertsteuereinnahmen) gerecht werden.
