Das Urteil des Bundesverfassungsgerichts zum Länderfinanzausgleich

Abstract

Mit dem Urteil des Zweiten Senats vom 11. 11. 1999 hat das Bundesverfassungsgericht über die Normenkontrollanträge der Länder Baden-Württemberg, Bayern und Hessen entschieden1. Die Klagen dieser drei Bundesländer richteten sich gegen einzelne Bestimmungen des Finanzausgleichsgesetzes, das sie für verfassungswidrig halten. Dabei ging es insbesondere um das hohe Ausgleichsniveau im Länderfinanzausgleich und um die Änderung in der Reihenfolge der Finanzkraft. Wie ist das Urteil unter ökonomischen Aspekten zu bewerten?
